Kate O'Raghallaigh

Kate O'Raghallaigh specialises in extradition, criminal appeals and crime-related public law. Kate regularly appears in the City of Westminster and the Administrative Court in Part 1 and Part 2 cases. Kate has conducted a number of significant cases in the past year, including the first High Court ruling on jurisdiction in costs appeals (Skraba v Poland 2014 EWHC 2193 (Admin)); Katrencik v District Court Bratislava III 2014 EWHC 2062 (Admin), a CPS appeal in which the Appellant argued that Slovakian mandatory drugs sentencing violated Article 3 ECHR, and Nowak v Poland (2014 ' yet to be published), the first published case in which the High Court accepted that an appellant could be discharged in relation to one offence in a multiple offence EAW pursuant to Article 8 ECHR. Kate has particular experience in seeking urgent interim relief in Part 1 and Part 2 cases as well as drafting applications for interim relief from the European Court of Human Rights. Kate also appears before the Privy Council in capital cases from the British Commonwealth and regularly appears in prison-related judicial review claims.
