EXPLANATORY NOTE

EXPLANATORY NOTE (This note is not part of the Order)

The Local Government (Best Value Authorities) (Power to Trade) (England) Order 2004 (“the principal Order”) authorises certain local authorities to trade in any of their ordinary functions subject to certain conditions. The principal Order was amended by SI 2004/2307 to provide transitional arrangements in respect of certain fire and rescue authorities allowing those authorities to continue trading in specified functions notwithstanding the repeal of the Fire Services Act 1947 by the Fire and Rescue Services Act 2004.

This Order amends the principal Order to take account of the Devon and Somerset Fire and Rescue Authority, created by virtue of SI 2006/2790.

A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
