EXPLANATORY NOTE
(This note is not part of the Regulations)These Regulations are made under section 2(2) of the European Communities Act 1972.
The Regulations set fees for a number of steps in the third stage of the European Community review of active substances for plant protection products. The review of active substances was established by Council Directive 91/414/EEC concerning the placing of plant protection products on the market (OJ L230, 19.8.1991, p 1) as amended and detailed rules for the conduct of the third stage of the review are set out in Commission Regulation (EC) No 1490/2002 (“the Commission Regulation”).
The steps for which fees are established are:
the administrative treatment and checking of data lists under Article 6 of the Commission Regulation and for conducting completeness checks of dossiers in accordance with Article 9 of that Regulation for which a fee of £5,000 is set; and
the evaluation of dossiers under Article 10 of the Commission Regulation for which a fee of £127,000 is set.
The Fee for Initial Assessment of Active Substances for Pesticides Regulations 2003 are revoked. The 2003 Regulations also set a £5,000 fee on the same basis as above, but these Regulations make it express that where there is more than one notification of data lists and dossier submitted for the same active substance, the fee is payable for each such submission.
