1 Citation, commencement and interpretation

(1)    This Order may be cited as the European Communities (Designation) (No 2) Order 2002 and shall come into force on 20th May 2002.

(2)    In this Order—

“the Act” means the European Communities Act 1972,

“Minister or government department” means a Minister of the Crown or government department, but does not include a Northern Ireland Minister or Northern Ireland department,

“regulations” means regulations made pursuant to section 2(2) of the Act.

2 Designation of the National Assembly for Wales

2Designation of the National Assembly for Wales

(1)    For the purposes of section 2(2) of the Act, the National Assembly for Wales is designated in relation to the matter specified in the Schedule to this Order.

(2)    Regulations made by the National Assembly for Wales pursuant to this Order shall apply in relation to Wales only.

(3)    Where the National Assembly for Wales is designated by this Order in relation to any matter, for which any Minister or government department is designated by this or any other Order for the purposes of section 2(2) of the Act, any of them may make regulations and, if regulations are made by more than one, they may do so jointly.

The implementation of the plans and programmes set out in the following documents—

(a)    the Welsh Office's Single Programming Document for Community Structural Measures in Rural Wales in respect of Objective 5b approved by Commission Decision No C(95)4 of 6th January 1995,

(b)    the National Assembly for Wales' West Wales and the Valleys Objective 1 Single Programming Document 2000–2006 approved by Commission Decision No C(2000) 2049 of 24th July 2000,

(c)    the National Assembly for Wales' Rural Development Plan for Wales 2000–2006 approved by Commission Decision No C(2000)2932 of 11th October 2000,

(d)    the National Assembly for Wales' East Wales Objective 2 and Transitional Programme Single Programming Document approved by Commission Decision No C(2001)657 of 26th March 2001,

(e)    the National Assembly for Wales' LEADER+ Single Programming Document for Wales 2000–2006 approved by Commission Decision No C(2001)1379 of 2nd July 2001,

in so far as such implementation relates to the operation of the European Agricultural Guidance and Guarantee Fund.
