UPDATING
EF&P is updated on a rolling basis throughout the year in response to changes in practice and the law. As a minimum, this means 1 release per month. A release may include:

  • A complete rewrite of material in a single title, including commentary and precedents

  • Amended precedents only

  • Information notes highlighting forthcoming changes

The team review the material across the titles, and new developments in the law and practice are reflected in title rewrites or selective updating.

EF&P is contributed by specialist authors; therefore all new legislation cannot be incorporated immediately.


Date stamps
Titles and precedents state when (and, where practical, how) they have been amended. Italic text under precedent headings, and bold text at the end of title overviews, show the date and nature of amendments. The dates on which titles were last reissued and amended are also in the list of titles and authors below.

Terms used in date stamps mean the following:

EFP 24(1): 11/2011 or Volume 24(1) Landlord and Tenant (Social Housing): 11/2011—This title has been reissued to take into account the law as at that date.

Fully revised 01/2012—This precedent or title has been revised to take into account all changes to the law made up to and including that date.

LOCAL GOVERNMENT AND RATING February 2019, vol 26(2)A
LOCAL GOVERNMENT has been revised by Ian Davison and Kate Jackson. Ian Davison is a partner at Surrey Hills Solicitors LLP specialising in local authority law and practice, having worked in and for local government for nearly 40 years. He is also legal advisor to several county associations of local councils. He also advises charities and voluntary groups. Kate Jackson is a partner at Surreys Hill Solicitors LLP specialising in employment and conflict resolution and also has a local government practice.

LOCAL GOVERNMENT has been updated to take account of the substantive changes introduced by legislation such as the Local Audit and Accountability Act 2014 and the Public Contracts Regulations 2015. Local government in England and Wales (and to an extent London) are now so divergent that the work concentrates on local government in England. Recent changes include significant additions and revisions to the law on the following:
— the developing general power of competence conferred on local authorities by the Localism Act 2011;
— local government reorganisation and combined authorities;
— electoral and boundary reviews;
— parishes and parish councils and community governance reviews;
— governance arrangements that affect principal local authorities;
— standards committees and the localisation and recasting of the standards regime relating to the conduct of councillors;
— the role and powers of the Commission for Local Administration (the Local Government and Social Care Ombudsman);
— information managements: data protection and transparency;
— accounts and audit; and
— best value, the community right to challenge, the community right to buy and the community right to reclaim land.

The forms and precedents, which complement the commentary, include a range of orders and notices on the constitution and organisation of authorities, documents on the discharge of the functions of local authorities, and documents on the standards regime.

RATING has been revised by Clive Moys. Clive is a barrister at Radcliffe Chambers, where he has been in practice for 20 years, specialising in planning, property and local government law, including rating and valuation. He also practised as a solicitor in local government for 10 years before being called to the Bar.

RATING includes commentary on both non-domestic rating and the council tax, and sets out forms and precedents that are relevant to both regimes. The volume has been updated to take account of changes introduced by the Localism Act 2011 and the Local Government Finance Act 2012 together with much subordinate legislation. The commentary also references important recent non-domestic rating cases including: Woolway v Mazars 2015; Newbigin (Valuation Office) v SJ & J Monk (a firm) 2017; Delph Property Group Ltd v Alexander (VO) and Leicester City Council 2018; and Gardiner & Theobald LLP v Jackson (VO) 2018.

SALE OF LAND February 2019, vol 35
Volume 35 SALE OF LAND (2019) has been completely revised and updated by Andrew Whittaker LL.B., Solicitor. Andrew Whittaker was previously managing partner at Maples Teesdale where he had an extensive practice advising land owners, occupiers, investors and developers on a wide range of commercial and residential property issues. He now writes on property matters and provides property law training consultancy services at post-qualification level both for individual law firms and public course providers. Andrew also contributes to Atkin’s Court Forms.

The volume consists of an outline of the steps to be taken by solicitors when acting on the sale or purchase of residential property, supported by detailed commentary relating to the relevant law and practice and an overview of certain specialist topics a conveyancer may encounter from time to time. The volume also incorporates details of the standard forms currently in use in residential conveyancing, and a selection of precedents relating to the taking of instructions from, and reporting to, clients including a terms of business letter.

The commentary has been updated to take account of recent changes in practice and regulation such as: the new Law Society Conveyancing Protocol published on 1 October 2018; the Law Society Practice Notes relating to Flood risk (last updated February 2016), Consumer Protection Regulations in Conveyancing (February 2016), Client care information (June 2018) and Consumer Contract Regulations 2013 (October 2018); the publication of the Standard Conditions of Sale (5th Edn—2018 Revision) and CON 29 and 29O (2016); the amended version of the Law Society’s Code for Completion (effective from May 2019); the SRA Ethics Guidance Transparency in price and service (October 2018); the SRA Price Transparency Rules 2018; and the Consumer Code for Home Builders: Consumer Code Requirements and Good Practice Guidance for Home Builders (4th Edn: September 2017).

The volume reflects the substantial amount of primary and secondary legislation that has been introduced affecting this area of practice in the recent past including: amendments to the Consumer Protection from Unfair Trading Regulations 2008; the Energy Performance of Buildings (England and Wales) Regulations 2012; the Enterprise and Regulatory Reform Act 2013; the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013; the Co-operative and Community Benefit Societies Act 2014; the Consumer Rights Act 2015; the Infrastructure Act 2015; the Small Business, Enterprise and Employment Act 2015; the Insolvency (England and Wales) Rules 2016; the Local Land Charges Rules 2018; the draft Overseas Entities Bill; and the repeal of the Property Misdescriptions Act 1991.
