The Case
Trust and trustee Creation of trust. In a dispute between family members in respect of a house, the Court of Appeal, Civil Division upheld the decision of the Chancery Division that on the evidence, L had declared a trust of the house on the terms of a deed of trust. Further her declaration had been 'manifested and proved' by some writing signed by her sufficient to satisfy the writing requirements of of the Law of Property Act 1925.
