Judgment - Enforcement - Foreign judgment - Defendant, S, controlling Russian companies - Claimant bank obtaining judgments against S in Russia - Bank seeking to enforce judgments against S - S submitting, among other things, judgments being otained by fraud and contrary to English public policy to enforce them - Whether S having prospect of successfully defending enforcement of principal sums and contractual interest claimed - Whether arguable defence on public policy grounds.
Judgment Enforcement. The claimant bank sought to enforce judgments obtained in the Russian courts against the defendant, S, and companies that he controlled, in the English court. The Commercial Court held that S had no prospect of successfully defending enforcement of the principal sums and contractual interest claimed in the enforcement proceedings. Therefore, judgment would be given against him.
