The Case

Dispute arising as to alleged infringement of claimant's United Kingdom patent Judgment in default being granted to claimant company. The Patents County Court considered applications in a case relating to the alleged infringement of a United Kingdom patent. The first defendant had failed to comply with an order of the court and as a result, its defence had been struck out and judgment entered for the claimant. The court held, inter alia, that it would be appropriate for a summary assessment of costs to be conducted in writing, and for the claimant to be given liberty to apply for an order for dissemination.
