Employment - Contract of service - Breach of contract - Breach of restraint of trade clauses and breach of fiduciary duties - Claimant company bringing proceedings - Whether defendants in breach.
Employment Contract of service. In the instant case, it was decided that the defendants had breached certain fiduciary duties after they had resigned from the claimant company and taken up employment with a different company. The first defendant had been in breach of his contractual obligation not to disclose confidential information to his new employer; there was nothing to implicate the second and third defendants in that regard.
