Sentence - Custodial sentence - Recommendation for deportation - Seriousness of offence - Possession of false identity card - Whether judge erring in recommending deportation.
Sentence Custodial sentence. In respect of the defendant pleading guilty to possessing a false identity document, contrary to s25 of the the sentencing judge had not been entitled to conclude that her continued presence was detrimental to the United Kingdom and to recommend her deportation. There was nothing on the facts of the instant case that the judge could add to the material that would be before the Secretary of State for the Home Department.
