Conflict of laws - Foreign judgment - Recognition and enforcement - European Union - Judgment relating to land in area controlled by Turkish Republic of North Cyprus - Whether judgment enforceable in English court - Council Regulation (EC) 44/2001 - Treaty of Accession, Protocol 10.
A judgment from a court of the Republic of Cyprus relating to the area controlled by the Turkish Republic of North Cyprus (TRNC) was not enforceable in the English court pursuant to Council Regulation (EC) 44-2001, since the effect of Protocol10 to the Treaty of Accession of Cyprus to the European Union was that the acquis, and therefore Regulation 44-2001, were of no effect in relation to matters which related to the area controlled by the TRNC.
