The Case

Where an offender had committed a murder in the course of a robbery, and mitigation existed because of his age at the time of the commission of the offence; that a guilty plea having been entered following the disclosure of DNA evidence which linked the offender to the crime; and the fact that there was no intention to kill in the course of a robbery, the appropriate term to be set on a reference by the High Court for a minimum term to be set pursuant to para6 of Sch22 to the would be 15 years' imprisonment, less 8 months and 3 days for time spent by the offender on custody on remand.
