Sentence - Custodial sentence - Theft - Re-sentencing for breach of community-based sentence - Whether custodial sentence manifestly excessive.
Sentence Custodial sentence. The sentence of 18 months' imprisonment imposed of the defendant for breach of a community punishment and rehabilitation order that had been imposed upon his guilty plea to stealing 2,000 of goods from his employer was excessive having regard to the value of the goods and the credit that had been given for the guilty plea. Accordingly, a sentence of 12 months' imprisonment would be substituted.
