The Case

The court answered certain questions raised by the changes proposed by the trustees of a pension scheme in order to equalise the normal retirement dates for both male and female members following a decision of the European Court of Justice which decided that it was unlawful, under European law, to discriminate between men and women, for example by providing for pension benefits to be payable on retirement at different ages.
