Agent - Duty to principal - Duty of loyalty - Misuse of confidential information - Whether breach of duty of loyalty causing principal loss - Whether appropriate to restrain agent from misusing confidential information.
In the circumstances of the case, the second defendant had acted in breach of his duty of loyalty owed as agent to the claimant, and that breach had caused the claimant loss. Further, it was appropriate to restrain the defendants by injunction from misusing certain confidential information.
