Mortgage - Action to recover loan secured by mortgage - Guarantor - Interest on loan - Bank contending interest running from date earlier than that accepted by guarantor - Whether interest and bank costs running from earlier date.
In the instant case, interest did not begin accruing on the loan amount, secured by a mortgage entered into by the guarantor and his wife, until the letter from the bank to the guarantor and his wife on 3 August 2005.
