The Case

On an appeal by the mother against the making by the family proceedings court (FPC) of an interim care order, on the grounds that the reasons given by the FPC had been wholly inadequate, the court held that the FPC had provided insufficient reasons. Accordingly, the matter would be remitted to the FPC for rehearing. However, in view of the local authority's concerns about the welfare of the children, the court would make an interim care order pending that rehearing.
