Costs - Order for costs - Discretion - Disallowing costs of successful party - Conduct of parties - Whether court should depart from general costs rule.
On the application by the parties for their costs of two hearings in the course of proceedings between them, the court decided that the circumstances necessitated a departure from the general rule that costs followed the event. Accordingly, the court decided that the appropriate order should be that the costs of both sides should be their respective costs in the case.
