The Case

Commission Decision C (2002) 1702, cancelling a subsidy payable to the applicant for the implementation of an International Buyers' Exhibition and ordering repayment of the sum already advanced to the applicant, following the failure of that project to take place, had not been made in breach of art24 of Council Regulation (EEC) 4253-88 (on reduction, suspension and cancellation of assistance) and the applicant's complaints about the contested decision alleging breach of the principles of proportionality, protection of legitimate expectations and legal certainty, and failure to state reasons were unfounded.
