Solicitors - Professional negligence - Claim - Allegation of negligent conduct in conveyancing.

The Case

By failing to consider a contract of sale of a leasehold property properly and advise on its meaning and the dangers inherent in it with the result that the claimant had failed to comply with a notice to complete the purchase, the defendant solicitor had been negligent. However, since the claimant had not had the necessary arrangements to finance that property, recovery of damages would be limited to a return of the relevant deposit and recovery of the costs incurred in proceedings alleging that the notice had been invalid.
