The Case

On an appeal from a decision of the employment tribunal, the Employment Appeal Tribunal ruled that the tribunal had failed to determine the correct question in considering the complaint and had, moreover, substituted its decision for that of the employer on the evidence. Accordingly, the appeal would be allowed.
