Practice and procedure - Summary judgment - Libel proceedings - Right to trial by jury - Application for summary judgment in relation to issues to be decided by jury at trial.
The defendant's application for summary judgment or to strike out the claimants' libel claim was dismissed since in the circumstances, it could not be said that the claimants had no real prospect of success either in convincing a jury to find for them or in obtaining more than nominal damages if successful.
