Employment - Employment Appeal Tribunal - Preliminary hearing - Costs - Appellant withdrawing serious allegations of bias on morning of preliminary hearing - Order for costs against appellant.
Where an appellant in the Employment Appeal Tribunal made grave allegations of bias against the chairman of the employment tribunal, and then withdrew those allegations on the morning of a preliminary hearing in the appeal tribunal, an award of costs in the employee's favour was deserved even though the hearing was only a preliminary hearing.
