Companies - Unfair prejudice to members - Exclusion of member from management of company - Refusal by other members to purchase shares
On the presentation of a petition under s459 of the the court ruled, inter alia, that, on the evidence, that the petitioner's conduct was such that it had justified his removal in the interests of the company on an objective view and he had failed to make good his allegations of unfair prejudice. Accordingly, the petition would be dismissed.
