Contract - Form - Written terms - Allegation of subsequent oral variation - Existence of oral agreement.
On the facts, the court accepted that there had been no oral agreement varying a written agreement made between the claimants and the defendant and, accordingly, the court was satisfied that the claimants were entitled to judgment in the case and also entitled to have the counterclaim by the defendant dismissed.
