The employer's appeal against the employment tribunal's decision that the employee's employment amounted to an undertaking, which had been transferred to the employer under the provisions of the Transfer of Undertakings (Protection of Employment) Regulations 1981, was allowed as the tribunal had come to that conclusion without consideration of any of the contractual documentation in the matter.
