Representation Mark Warwick (instructed by Jeffrey Green Russell) for the appellant.
Ian Mill QC and Adrian Briggs (instructed by Forbes Anderson) for the respondent.
Judgment Dates: 28 February 2003

Conflict of laws - Enforcement of judgment - Foreign judgment - Finality and conclusiveness - Multiple damages - Application in foreign court to amend damages to include multiple element - Enforceability of judgment in English court - s 5.

The Case

An application to adjust or amend the quantum of a debt which did not challenge the existence of the debt itself was unlikely to prevent a foreign judgment which had been determined on the merits from being final and conclusive, and therefore such a judgment was likely to be enforceable in the English courts.
