Employment - Unfair dismissal - Reason for dismissal - Range of reasonable responses test - Employment tribunal finding dismissal of employee not reasonable response by employer - Correctness of decision.
Where an employment tribunal had fallen into error and set out its own conclusion as to the facts, replacing the findings of the employer that dismissal of the employee had been a reasonable response to his conduct, the matter would be remitted to another tribunal to reach a further decision properly directed as to the law.
