The Case

The employee's appeal against a decision of an employment tribunal that her claims of race and sex discrimination be dismissed on the grounds that the manner in which her proceedings had been conducted was scandalous, was allowed on the ground that the tribunal had not taken relevant factors into consideration when making its decisions pursuant to r 13(2)(e) of Sch 1 to the Employment Tribunal (Constitution and Rules of Procedure) Regulations 1993.
