The Case

In all the circumstances, the employment tribunal was entitled to find that although it was not unreasonable for the employees initially to refuse to take suitable alternative employment on the basis that the employer had not adequately explained the alternative employment, the employees had failed to mitigate their loss by not accepting the alternative employment once an explanation had been given.
