Employment - Practice - Discrimination - Disability - Employee bringing complaint of disability discrimination by employers out of time - Tribunal refusing to exercise discretion and allow claim to proceed - Whether tribunal in error - s 8.
In the instant case, there had been nothing in the employee's originating application which could properly be regarded as indicating a disability discrimination claim. In those circumstances, the employment tribunal had been entitled to find that a complaint of disability discrimination had been made out of time.
