Costs - Patents County Court - Level of costs to be awarded in Patents County Court.

The Case

Following the decision of the Court of Appeal on an appeal from a decision of the Patents County Court (see ), the court ordered that there should be a detailed assessment of the costs of the trial and of the appeal by a costs judge. The court expressed surprise at the level of costs expended in the instant case in the Patents County Court, which did not appear to reflect what had been envisaged by the Lord Chancellor when that court was set up. The court hoped that the costs judge would put his judgment in writing, so that it could be reported and could therefore inform practitioners as to the level of costs which would be awarded in the Patents County Court.
