Practice - Filing - Time limit for filing documents at court office - Claimant posting documents through letterbox of court after court office closed on last day for filing of documents - Whether documents filed on last day or on day following last day for filing - CPR 2.3(1).
A document was filed on a particular date at a court office, within the meaning of CPR2.3(1), where there had been mere delivery of that document to the court office on that particular date. Delivery to an office required no collaboration, and was a unilateral act on the part of the person making the delivery, and could accordingly occur outside the hours that the office was open.
