On the facts of the instant case, a decision of the Commission not to award the applicant funding under Council Decision(EC) 95-563 (on the implementation of a programme encouraging the development and distribution of European audiovisual works (Media IIDevelopment and Distribution) (19962000)) made under the Commission's guidelines (Call for Proposals8-2000) was annulled since the applicant ultimately bore the distribution costs of certain films in Sweden, and was accordingly fell within para2.4 of the guidelines.
