Representation David Alexander (instructed by Moon Beever) for the interim receiver.
Anthony Bompas QC (instructed by Berg & Co) for the respondents.
Judgment Dates: 4 October 2002

Winding up - Partnership - Interim receiver's application - Interim receiver making applications in relation to respondent partners' assets and legal and living expenses - Whether applications should be granted.

The Case

The interim receiver's application in the winding up of the respondents' partnership, for, further control over the respondents' assets and for the imposition of a cap on their legal expenses and limit on their living expenses was granted on the basis that on the evidence, the respondents did not need as much as they had requested for living expenses, and that the respondents could spend what they requested on legal fees, as long as that sum was within the cap imposed.
