The Case

On an appeal by the Commissioner of the Metropolitan Police against a decision by the chairmen of the employment tribunal to allow an amendment to the employee's claim for racial discrimination, the court ruled that the chairman had erred in reaching his decision. Accordingly, the appeal would be allowed and the matter remitted to a different chairman for consideration of any amendment sought by the employee.
