Peter Smith J

Representation Peter Irvin (instructed by Healeys) for the claimant.
The defendant did not appear and was not represented.
Judgment Dates: 11 October 2002

Contempt of court - Breach of court order - Sanction - First defendant failing to comply with terms of freezing order obtained on without notice application - Whether first defendant in contempt of court.

The Case

On the claimant's application to have the first defendant found guilty of contempt for non-compliance with the terms of a freezing order, the court ruled that a custodial penalty would have been a matter of indifference to the first defendant, who was already in prison and that a financial sanction was therefore appropriate.
