Gage and Poole JJ

Representation Amanda Hamilton (assigned by the Registrar of Criminal Appeals) for the defendant.
Judgment Dates: 1 October 2002

Sentencing - Custodial sentence - Duration - False accounting.

The Case

Whilst the judge had been right to take the view that a custodial sentence was justified for six offences of false accounting, in passing a sentence of 18 months' imprisonment, he had failed to give sufficient weight to the defendant's personal mitigation and to recent observations of Lord Woolf CJ. Accordingly the sentence would be reduced to 6 months' imprisonment.
