Compulsory acquisition of land - Compensation - Claim - Costs - Principles to be applied to award of costs.

The Case

The Civil Procedure Rules had no application in proceedings before the Lands Tribunal. If as a result of applying the principles of ordinary litigation to the hearing of compensation references the tribunal adopted a practice of ready departure from the principle that the successful claimant was entitled to his costs in the absence of a special reason to the contrary, that would involve a change to the approach which had previously and properly been adopted in compensation reference cases.
