The employee's appeal against the employment tribunal's decision to dismiss his complaints of unfair dismissal under ss98(4) and 100 of the was dismissed as, the instant case was exceptional in that despite the tribunal misdirecting itself, they would inevitably have arrived at the same decision, even if they had directed themselves correctly.
