Employment - Employment appeal tribunal - Procedure - Application for review of employment tribunal's decision - Chairman of tribunal concluding application having no reasonable prospects of success - Remission of matter to same tribunal - Employment Tribunals (Constitution and Rules of Procedure) Regulations 2001, Sch 1, rr 13(5), 13(6).
Notwithstanding that the employment tribunal, which had determined an employee's compensation for unfair dismissal, included a chairman who had determined, under the tribunal's rules of procedure, that the employer's case for a review of that determination had no reasonable prospects of success, the matter would be remitted to that same tribunal.
