The Case

Where the claimant had originally obtained an order against a newspaper compelling it to disclose the source of information contained in an article which had been obtained in breach of confidence, and the newspaper had disclosed the source as being the defendant to the instant action, it was held that the claimant was entitled to summary judgment where it sought a similar order compelling the defendant to disclose his source.
