European Communities - Competition - Rules of competition - Enforcement - Fine imposed for infringement - Definitive transfer of power to impose fines to Court of Justice - Entitlement of Commission to impose fines on adoption of subsequent decision arising out of same facts - Decision imposing fines annulled by Court of First Instance on basis of illegality.
A judgment of the Court of First Instance had to be annulled in so far as it had dismissed a plea relied on by one of the appellants and failed to examine a plea raised by that appellant. However, the Court of Justice, exercising its jurisdiction to deliver final judgment on a successful appeal, dismissed the action resulting from those pleas.
