Medical practitioner - Negligence - Causation - Hospital negligently failing to carry out liver tests on deceased - Deceased subsequently dying of cirrhosis of the liver - Whether hospital's negligence a causative factor in deceased's death.
On the evidence, the defendant NHS trust's admitted negligence in failing to carry out a liver test on the deceased was held to have been a causative factor in his death from cirrhosis of the liver, and agreed damages in the sum of 175,000 were awarded accordingly.
