Pumfrey J

Representation Benet Brandreth (instructed by DLA, Leeds) for the respondent.
  The applicant appeared in person.
Judgment Dates: 2 October 2002

Judgment - Order - Setting aside - Respondent obtaining judgment against applicant and defendant companies for infringement of trade mark and passing off - Respondent subsequently obtaining order requiring Registrar of Companies to change names of defendant companies - Applicant applying to set aside subsequent order - Whether application should be granted.

The Case

The applicant's application to set aside and stay the enforcement of the relevant order was dismissed on the ground that that order was a final order and not an interlocutory order which the court had only limited powers to interfere with, and could only be proceeded with by way of appeal to the Court of Appeal.
