The Case

The employee's appeal against a decision of an employment tribunal dismissing her complaints of unfair constructive dismissal and indirect sex discrimination was allowed, on the grounds that the tribunal had not adopted the correct approach in deciding on the issue of justification, and had not explained how the minority opinion had been reached.
