The Case

On the company's application for an injunction restraining the respondent company from presenting a winding up petition against it, the court was not satisfied that on the evidence the company had bona fide cross-claims, and the application was dismissed. However, since the company proposed paying the respondent by a certain date, the court would grant the company a short injunction until that date.
