The Case

Costs would be awarded against an employee upon the withdrawal of his appeal, notwithstanding that he was represented by a charitable organisation, because he had failed to accept an offer, made months earlier by the employer, that if the employee would withdraw his appeal, it would not seek to recover its costs from him.
