Judge Langan QC sitting as a judge of the High Court

Representation Edward Bragiel (instructed by Collier Bristow) for the claimant.
Barbara Rich (instructed by Lee & Pembertons) for the defendant.
Judgment Dates: 15 November 2002

Estoppel - Proprietary estoppel - Promised legacy in will - Detrimental reliance.

The Case

The claimant's reliance, inter alia, on the doctrine of proprietary estoppel, was well founded as, on the facts, the testator's promise and the claimant's detriment was easily established, and the defendant had failed to discharged his burden to prove that the claimant had not relied on the testator's promises.
