The Case

The occupier's duty of care was the same in all cases but its application depended, and depended crucially, upon all the circumstances of the particular case before the court. An occupier had to take reasonable care to see that his visitors were reasonably safe, but he did not guarantee their safety and the defendant had not, therefore, broken his duty of care in the particular circumstances of the instant case.
